Licensing

CHEESEHEAD builds on various existing software and source codes, collectively referred to as “Background IP” (intellectual property). A wide range of legal entities, funding arrangements etc. contributed to creating the Background IP, which is consequently subject to varying terms of use, licensing and copyrights. The appendix identifies the Background IP and corresponding repository locations, points of contact, terms and conditions, etc. Information about the appendix can be found at the end of this document.

CHEESEHEAD will further develop the Background IP, as well as create new, independent software and source codes, collectively referred to as the “Project IP”. All CHEESEHEAD participants are encouraged to make their Project IP freely and openly available as soon as possible, but no later than the CHEESEHEAD award end date (i.e., 31 July 2021).

Project IP that constitutes new, independent software, source codes, additional documentation, developer’s guides etc. is available from the CHEESEHEAD Project Code Repository (CPCR; https://github.com/DesaiLab/CHEESEHEAD). Users are hereby granted a license to access and use Project IP from the CPCR, unless otherwise stated, subject to the terms and conditions of the GNU Affero General Public License 3.0 (AGPL-3.0; https://www.gnu.org/licenses/agpl-3.0.en.html). By using or downloading Project IP from the CPCR, the user agrees to the terms and conditions set forth in this document.

Data, materials or software included or linked from archives external to the CPCR, are subject to their own specific terms of use, licensing and copyrights. In particular, Project IP that constitutes further developments of the Background IP is available from the Background IP repositories, where it is subject to the terms and conditions inherited from the Background IP repository. In the absence of specific terms of use, the terms of use set out in this code policy shall apply. The burden of determining that the use of any data, materials or software on or linked to the CPCR is permissible rests with the user.

Software and Source Code Access and Acknowledgement

1. All investigators participating in CHEESEHEAD agree to promptly submit real-time snapshots of their software and source codes in development to the CPCR or associated Background IP repositories at the latest by 31 July 2021.
2. All software and source codes shall be promptly provided to other CHEESEHEAD investigators upon request. All CHEESEHEAD investigators will have equal access to all software and source codes, where applicable subject to Background IP terms and conditions.
3. Investigator(s) who own the copyright to the software and source codes must be notified first of the intent to use the software and source codes, in particular if software and source codes are to be provided to a third party (e.g., journal articles, presentations, research proposals, other investigators). Investigator permissions and requirements must be met prior to sharing software and source codes publicly. It is strongly encouraged that the PIs owning the copyright to the software and source codes be invited to become collaborators and co-authors on any projects, publications and presentations. If the contribution of the software and source codes is significant to the publication, the PIs owning the copyright to the software and source codes should be offered the right of co-authorship. Any use of the software and source codes should include an acknowledgment (i.e., citation). In all circumstances, the PIs owning the copyright to the software and source codes should be acknowledged appropriately. Users of the software and source codes are strongly encouraged to contact the relevant PIs prior to incorporating it into peer-reviewed publications.
4. International agencies, professional societies, and research organizations are moving towards requiring researchers to formally cite data and sources that led to a given research result. To support this, DOIs or Digital Object Identifiers (considered “perpetual” identifiers) will be assigned to CPCR code releases via an acceptable DOI generation service (e.g., https://zenodo.org, etc.). These DOIs should be used in CHEESEHEAD related publications. For “perpetual” identifiers to archives external to the CPCR, in particular to the Background IP repositories in appendix, please review the corresponding terms and conditions and where necessary contact the Point of Contact for that repository.

Appendix

The appendix is accessible here and lists various existing software and source codes, i.e. the Background IP, that are used in CHEESEHEAD while maintained in archives external to the CPCR. It identifies corresponding repository locations, points of contact, terms and conditions, etc.

To have your code included in this appendix, please email code name, code description, repository location, point of contact (name/email), relevant measurements, primary language, terms and conditions, primary reference, and any comments to eol-archive@ucar.edu. This will advertise and encourage use of your code, ensure proper acknowledgement, and allow users to understand any restrictions.
